Terms and conditions of using the XOMB HR system. Please read carefully before using our services.

1. Acceptance of Terms

By using the Xomb-HR system, you agree to the terms and conditions of XoMB Technologies Private Limited, and these terms and conditions come into effect from the date client starts using the system and remain in effect during the subscription period.

2. Definitions

  • The following are the definitions that will be used throughout the policy.
  • "XOMB HR" - is the brand name of the HRMS software provided by XoMB Technologies Private Limited.
  • "User" - means an individual or organisation, or an employee of an organisation
  • "System" - means Software services provided by XoMB Technologies Private Limited
  • "Data" - means all information added by the client to run the system.
  • "Account" - means a user account registered with XoMB Technologies Private Limited.
  • "Services" - means all services provided by XoMB Technologies Private Limited
  • "Software" - means SaaS provided by XoMB Technologies Private Limited

3. Use of System

Software uses permission:

  • Client is permitted to use the system as per the subscription plan and agreement signed.
  • Client can share access with authorized employees only.
  • Client can access the feature as per the subscription plan.
  • Client can download the reports from the system as per the format provided by the system.

Usage Limitations:

  • Client must comply with the Indian law
  • User count can be according to the selected subscription plan
  • System can not be used for illegal activities.
  • System can be used by an organisation that purchases the subscription: the subscription can not be transferred to others.

4. Prohibited Use

Clients are prohibited:

  • To use the system for illegal activities
  • To access or attempt to access other user data
  • To disrupt and hamper the operation of the system
  • To copy, modify, and distribute the system without permission
  • To send spam mail and malware using the system.
  • To share login details with unauthorized personnel
  • To reverse engineer the system to compete in the market

5. Payments and Charges

The following payment terms apply to all clients using the system:

  • License fee is non-refundable
  • Pricing is based on the package and number of employees
  • Payment must be made before the activation of the system
  • Payment is non-refundable after the activation of the package or subscription
  • Payment is non-refundable in case of cancellation of subscription
  • Payment can be made through bank transfer or cheque (For Enterprise Only)

6. Data Ownership and Privacy

Clients have the right to download their own data from the XOMB-HR System until it has a valid subscription. After the subscription ends, data will be stored only for 6 months on the server and will be deleted if the subscription is not renewed. You can only download the data from the XOMB-HR System in Excel/CSV format, and no digital backup of the database will be provided during subscription or after the end of subscription. Clients can request to delete their data immediately after the subscription ends by mail to info@Xombtechnologies.com.

7. System Availability and Support

Uptime Guarantee:

  • We have a target of 99.% uptime for all packages
  • Any scheduled maintenance will be informed 48 hours in advance
  • Any unscheduled downtime will be resolved as soon as possible

Customer Support:

  • Email support: response time is 24 hours
  • WhatsApp support: Office hours only
  • Telephone support: As per the Plan and subscription
  • Dedicated Support Manager: According to the package and subscription

8. Limitation of Liability

Disclaimer of Warranty:

  • System is provided "as is" with no implied warranty
  • We do not guarantee an entirely error-free system
  • We are not liable for data loss due to the user's mistake

Limitation of Compensation:

  • Our maximum liability is limited to the amount paid in the last 12 months
  • XoMB Technology is not liable for any indirect losses or loss of profit
  • Compensation covers only proven direct losses and is limited to the payment paid in the last 12 months

9. Account Termination

Termination by Client:

  • Client can request termination of his account
  • Client's data will be stored for 90 days after the termination of the account
  • Data will be deleted permanently after 90 days of the retention period
  • No digital database backup will be provided

Termination by XoMB Technologies Private Limited:

  • In case of violation of terms and conditions
  • In case of Suspicious or illegal activity
  • In case of non-payment of the subscription fees

Effects of Termination:

  • Access to the system will be terminated immediately
  • Data can be exported only in Excel/CSV format before termination
  • Paid fees will not be refunded

10. Governing Law

These terms and conditions are governed by the laws of India. Any disputes shall be resolved in Indian courts with Panchkula jurisdiction.

Final decision of any dispute that is not governed by Indian law will be made by XoMB Technologies Private Limited.

11. Changes to Terms

Terms and conditions are subject to change from time to time, and any change to Terms and conditions can be seen on our website and using the system with subscription and renewal of subscription will be treated as the client agrees to our Terms and conditions.
